Accordingly, we have established this Privacy Policy to ensure that a visitor’s or a customer’s information is handled in a safe and responsible manner. Your Consent and Changes to This Policy:
By using our Site, you consent to the collection and use of information by us in accordance with the terms of this Privacy Policy. If we decide to change our Privacy Policy, we will post the new Privacy Policy reflecting those changes on our Site so you are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. Disclosure Required by Law:
We may disclose Personal Information when required by law or when we believe in good faith that such action is necessary in order to conform to the edicts of the law or comply with a court order or legal process served upon TruView or any of its officers or principals. We further reserve the right to disclose such information when TruView reasonably believes that it is needed to identify, contact, or bring legal action against a party who may be violating TruView’s Terms of Use or may be causing injury to or interference with TruView’s rights or property, registered customers or potential customers of TruView, or anyone else that could be harmed by such activities.
Children’s Privacy:
Our website is a general-audience website and is not directed to anyone under the age of thirteen (“Children”). We do not seek to solicit information from Children. If Children submit information to us and we know that the individuals submitting the information are indeed Children, we will delete the information as soon as we discover it, we will not use the information for any purpose, and we will not disclose the information to third parties. We urge parents and guardians to participate in their Children’s online activities and use parental control or Web filtering technology to supervise Children’s access to the Internet.
PERSONAL INFORMATION PRIVACY POLICY
TruView BSI, LLC (“TruView”) is committed to protecting the personal information it receives from and about consumers. Accordingly, TruView has developed this Privacy Policy in order for interested parties to understand how TruView collects, uses, discloses, and protects consumers’ personal information. This Privacy Policy applies to personal information about consumers provided by TruView’s clients as well as by individuals who have provided TruView’s clients with written authorization to disclose their personal information (e.g., TruView’s clients’ employees and job applicants).
TruView reserves the right to make changes to its Privacy Policy at any time. Changes to the Privacy Policy are effective upon posting. Please review this Privacy Policy periodically.
Consumer Reporting. TruView is a consumer reporting agency, as defined by the Fair Credit Reporting Act, 15 U.S.C. §1681 et seq. (“FCRA”) and other applicable state and federal laws, and is required to maintain the confidentiality of all personal information it receives. TruView collects and uses all personal information in compliance with the FCRA. TruView does not, however, maintain a database of consumer personal information.
TruView obtains information on an individual consumer only upon the request of a user (e.g., TruView’s client) who has a permissible purpose under the FCRA to request such information. The FCRA requires the user certify to TruView that it has obtained the consumer’s written consent to request information before TruView can supply the requested information. The user must submit to reasonable audits by TruView to confirm that it is, in fact, obtaining such consents.
Purpose of Collection of Personal Information. Before or at the time it collects personal information, TruView will specify the purposes for which the personal information is being collected. TruView will collect personal information by lawful means and use personal information solely for the specified purpose(s).
Protection and Retention of Personal Information. While TruView does not guarantee the security of any personal information, TruView utilizes reasonable security safeguards to protect personal information from access by unauthorized users. TruView only retains personal information for the amount of time necessary to fulfill the purpose for which the information was collected unless TruView is required by law to keep the information for a longer period. TruView will make readily available to clients information about our policies and practices relating to the management of personal information.
Privacy initiatives and procedures include, but are not limited to:
- Access to personal information is limited within TruView to those who have a business “need to know” the information. Access to TruView’s computer terminals, file cabinets, fax machines, trash bins, desktops, etc., are secure from unauthorized access.
- TruView maintains a secure network to safeguard personal information from internal and external threat.
- Any backup data is maintained in an encrypted form.
- TruView maintains records on each request for information and identifies each user who requested information on a consumer.
- Employees are prohibited from “browsing” files or databases without a business justification.
- TruView follows the Federal Trade Commission’s requirement that consumer information be unreadable upon disposal.
Disclosure of Personal Information to Third Parties. TruView does not share, sell or distribute consumer information to any third party without the consumer’s permission other than in the following situations:
- TruView may share consumer’s personal information with a third party as necessary in connection with any of the purposes for which the personal information was collected.
- TruView may retain a third party vendor to assist in background screenings. TruView will only transfer to these vendors the information necessary to perform the requested service, and prohibits the third party vendors from using the information for any other purpose. TruView only uses vendors who maintain a responsible attitude towards consumer privacy, mirroring TruView’s own practices. However, as TruView does not have direct control over the policies or practices of these third parties, TruView is not responsible for the practices of or the accuracy of the information received from third parties.
- TruView may be required, upon receipt of a court order, to disclose or release consumer information in civil litigation or as otherwise required by law.
- TruView may disclose personal information in connection with an investigation or other efforts to prevent illegal activity or preserve public safety.
Personal Information Disclosure: United States or Overseas. Occasionally, during the course of normal business, TruView has to provide personal information to third parties overseas. TruView does not transfer information to third parties outside of the United States or its territories unless necessary to provide services. When deemed necessary, TruView only uses third party vendors who are U.S. based and Safe Harbor certified. All personal information will be transmitted and stored in a secure manner in accordance with the terms of this Policy.
Access to Personal Information. Any consumer, upon proper identification, has the right under the FCRA to request that TruView furnish to the consumer any and all information it may have on that consumer. The consumer has the right to dispute the accuracy or completeness of any information contained in the consumer’s file. TruView will make a good faith effort to provide the consumer with access to the information. Children under the Age of 13. TruView does not knowingly collect information about children under the age of 13, offer services to children under the age of 13, or direct its website to children under the age of 13.
